The grave design, generated obituary text, site copy, and other site content are original to RIP GamerTag or used under license. Memorial text you submit remains yours; by publishing it you grant us a non-exclusive license to host, display, and reproduce it as part of the service (including in the share image and certificate).
Reporting infringement (DMCA notice)
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on this site infringes a copyright you own or are authorized to act for, send a written notice to our designated agent containing all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, with enough detail for us to locate it — for a memorial, its full URL.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
An incomplete notice may not be actionable. Knowingly making a material misrepresentation that content is infringing can make you liable for damages under 17 U.S.C. § 512(f).
Designated agent
Send DMCA notices to our designated agent:
[[NEEDS OWNER INPUT: DMCA designated agent name]]
[[NEEDS OWNER INPUT: DMCA designated agent mailing address]]
[[NEEDS OWNER INPUT: DMCA designated agent email address]]
[[NEEDS OWNER INPUT: DMCA designated agent telephone number]]
What happens next
On receipt of a compliant notice we will remove or disable access to the material expeditiously and make a reasonable attempt to notify the person who published it, including a copy of the notice. We terminate the accounts and publishing access of repeat infringers in appropriate circumstances.
Counter-notification
If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to the same designated agent above. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We will forward your counter-notification to the original complainant. If they do not notify us within 10 business days that they have filed an action seeking a court order to restrain the activity, we may restore the material in 10 to 14 business days after receiving the counter-notification.
Faster option for memorial content
For a specific memorial you can also use the "Report this memorial" link on its page and select "Copyright issue" — it routes straight to our moderation queue. That is not a substitute for a formal DMCA notice, which must go to the designated agent above.
